LEGAL INFORMATION

Contractual Terms of Use of the housingnet.com.au platform

If you browse or otherwise access any content or data on the housingnet.com.au platform (including its website, mobile site, apps, and voice assistant products such as accessibility facilities), you agree to be bound by these terms.

HOUSING NET PTY LTD (ABN 16 665 197 428) (trading as “Housing Net”) (Housingnet, we or us) operates an online platform allowing providers offering disability-friendly properties for lease or tenants of such properties looking for an Accommodation (Accommodation Provider) to advertise to a person whose needs are suited to the property (you, Housing Participant) via our platform at www.housingnet.com.au or any other platform we may introduce in the future (Platform).

Please read these terms and all the Housingnet policies including our Privacy Policy and any Community Guidelines, (collectively the Agreement) carefully before signing up to become a Participant, an Accommodation Provider, or an Allied Health Provider.


By signing up to have an account on the Platform and use the services offered by us (“Housingnet Services”)  you agree to be bound by this Agreement.

HOUSINGNET SERVICE

Housingnet provides the Platform that allows:

 

  • Allow NDIS participants to find a suitable property, Housingnet has control and interaction with the Provider or description of the properties listed on the Platform.

  • Allows NDIS participants to search for appropriate healthcare services, Housingnet has no control over the posting of images or information registered by Health Service Providers, or description.

  • Allows NDIS housing providers to display part or all of the images and videos of the homes they want to offer.

  • Allows health support professionals to post their health care services on the platform.

  • Provides more articles and tips on housing development solutions, and health development to support community development.

ELIGIBILITY TO REGISTER

  1. To create an account on the Platform and use the Housingnet Services you must be over 18 years of age. If you are under 18 you must have your parent or legal guardian’s permission to use the Services.

  2. While you are registered with the Housingnet, you must maintain control of your Housingnet credential. You must not allow others to use your account.

  3. At its reasonable discretion, Housingnet may refuse to allow any person to register or create an account with Housingnet or cancel or suspend any existing account.

HOUSING SERVICE DESCRIPTION

The Service will be reviewed and updated from time to time. In addition to the points set out below, certain portion(s) of the Service may be separately described on the Housingnet Platform.

 

An Accommodation Provider with disability-friendly properties to offer creates an account with Housingnet and posts an accurate and complete description of the property and other relevant information (sorting).

Healthcare providers providing disability-friendly support services will create an account with Housingnet and post an accurate and complete description of the information and eligible documents.

RESPECT FOR OTHERS

You will post only accurate information on the Housingnet Platform and any information posted on Housingnet Platform must not be potentially or actually harmful to Housingnet  or any other person. You must not use our Services for any illegal, harmful, or abusive activity. Any information you post to the Platform must be:

  1. up to date;

  2. not be false, inaccurate or misleading or deceptive;

  3. not infringe any third party’s intellectual property rights, rights of publicity, confidentiality or privacy;

  4. not violate any applicable law;

  5. not be defamatory, threatening or harassing;

  6. Do not use images or videos that are not truthful, misleading and deceiving viewers;

  7. Do not use vulgar, rude words, swear words or statements that mock others or cause misunderstandings about racism, territorial discrimination or cultural discrimination.

 

Housingnet may edit or remove any information published by you from the Platform at any time if Housingnet considers any information that you share is in breach of this Agreement, including not being kept up to date or being in any way inaccurate or misleading.

IDENTITY VERIFICATION

Housingnet may include tools to help Platform users to verify the identity of other users (Identity Verification Services). These tools may include email verification phone number verification technology.

LIMITATION OF LIABILITY

To the extent allowed by law, you agree that the Housingnet does not have any liability for any loss or damage from Participants ( Accommodation Tenants), House Providers or Allied Health Providers

To the extent allowed by law, the Service and the Platform are provided on an “as is” basis.

PRIVACY

Housingnet’s Privacy Policy, which is available at www.housingnet.com.au/privacy-policy, applies to all users and forms part of this Agreement. Use of the Housingnet Platform confirms that you consent to, and authorise the collection, use, and disclosure of your personal information in accordance with the Housingnet’s Privacy Policy. Please be careful when sharing your personal information with any third party.

 

MODIFICATIONS TO THE AGREEMENT

The Housingnet may modify this Agreement and / or any policies from time to time. The Housingnet will send notification of such modifications to your Housingnet account, where the Platform’s capability allows. You should check that account regularly.

If you do not agree with any changes to this Agreement, you may terminate your Housingnet account and stop using the Housingnet Services.

 

 

COPYRIGHT COMPLAINTS

If you believe that your intellectual property rights have been infringed, please send notice to the address below or fill out this form. We may delete or disable content that we believe violates these Terms or is alleged to be infringing and will terminate accounts of repeat infringers where appropriate.

TERMINATION

You or we may terminate an account and this Agreement at any time for any reason. We will provide reasonable notice to you if we do so. Termination of account activities must be agreed upon via email with reasonable notices attached.

Upon termination of this Agreement, Housingnet may immediately hide your information. All of your information will be stored for 2 years as hidden data from the date the account termination takes effect.

2-year temporary Storage only serves in case you want to restore terminated information and supports the auditing and monitoring activities of the Platform. After 2 years from when your account is determined to be terminated, all of your information will be completely deleted from the platform.

Any terms which by their nature should continue to apply will survive any termination or expiration of this Agreement.

 

DISCLAIMER OF WARRANTIES

OUR SERVICES ARE PROVIDED “AS IS.” EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE AND OUR AFFILIATES AND LICENSORS MAKE NO WARRANTIES (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE) WITH RESPECT TO THE SERVICES, AND DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NON-INFRINGEMENT, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF ANY COURSE OF DEALING OR TRADE USAGE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ACCURATE, OR ERROR FREE, OR THAT ANY CONTENT WILL BE SECURE OR NOT LOST OR ALTERED.

YOU ACCEPT AND AGREE THAT ANY USE OF OUTPUTS FROM OUR SERVICE IS AT YOUR SOLE RISK AND YOU WILL NOT RELY ON OUTPUT AS A SOLE SOURCE OF TRUTH OR FACTUAL INFORMATION, OR AS A SUBSTITUTE FOR PROFESSIONAL ADVICE

 

LIMITATION OF LIABILITY

NEITHER WE NOR ANY OF THIRD-PARTIES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA OR OTHER LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATIONS IN THIS SECTION APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

HOUSINGNET’S SUB-CONTRACTOR, SUPPLIERS, LICENSORS, AND DISTRIBUTORS ARE INTENDED THIRD-PARTY BENEFICIARIES OF THIS SECTION.

 

GENERAL TERMS

You may not assign or transfer any rights or obligations under these Terms and any attempt to do so will be void. We may assign our rights or obligations under these Terms to any affiliate, subsidiary, or successor in the interest of any business associated with our Services.

CHANGES TO THESE TERMS OR OUR SERVICES.

We are continuously working to develop and improve our Services. We may update these Terms or our Services accordingly from time to time. For example, we may make changes to these Terms or the Services due to:

Changes to the law or regulatory requirements.

  • Security or safety reasons.

  • Circumstances beyond our reasonable control.

  • Changes we make in the usual course of developing our Services.

  • To adapt to new technologies.

We will give you at least 30 days advance notice of changes to these Terms that materially adversely impact you either via email or an in-product notification. All other changes will be effective as soon as we post them on our website. If you do not agree to the changes, you must stop using our Services.

GOVERNING LAW.

This Agreement is governed by the laws of Victoria, Australia.

A failure by a party to exercise any right under this Agreement will not be considered a waiver of those rights. The provisions of this Agreement are severable, and if any provision of this Agreement is held to be invalid or unenforceable, such provision may be removed and the remaining provisions will be enforceable. This Agreement may be assigned or novated by the Housingnet provided there is no material detriment to you. This Agreement sets out the entire understanding and agreement between you and the Housingnet.

DELAY IN ENFORCING THESE TERMS.

Our failure to enforce a provision is not a waiver of our right to do so later. Except as provided in the dispute resolution section above, if any portion of these Terms is determined to be invalid or unenforceable, that portion will be enforced to the maximum extent permissible and it will not affect the enforceability of any other terms. 

TRADEMARK.
'Housingnet', the House covers the first Letters in the work "Housingnet" logo are the registered service marks of Australian Securities and Investments Commission.
'Housingnet' logo are the registered trade marks of Housingnet.

 

TRADE CONTROLS.

You must comply with all applicable trade laws, including sanctions and export control laws. Our Services may not be used in or for the benefit of, or exported or re-exported to any other country or territory or any individual or entity with whom dealings are prohibited or restricted under applicable trade laws. Our Services may not be used for any end use prohibited by applicable trade laws, and your Input may not include material or information that requires a government license for release or export.

ENTIRE AGREEMENT.

These Terms contain the entire agreement between you and Housingnet regarding the Services and, other than any Service-specific terms, supersedes any prior or contemporaneous agreements between you and Housingnet.
